These terms govern the purchase and use of prepaid credit for the ScrambleAI app, offered by Hermes Blockchain Ventures — Matthias Winter (sole proprietorship / Einzelunternehmen) ("we"). By buying credit you accept them. Version 29 August 2026.
Prepaid credit ("SCRAI") for the ScrambleAI app. Credit is spent on requests to third-party AI models (text and image generation) routed through the Nym mixnet. Credit is a usage allowance, not money, not a cryptocurrency, not transferable and not redeemable for cash.
Credit is sold in fixed amounts. Prices are shown in USD. We are a small business under § 19 UStG (German VAT Act): no VAT is charged or shown. One US dollar of credit equals 100,000 SCRAI. Every model shows its price per request or per 1,000 tokens inside the app before you send.
Payment methods: NYM and Bitcoin (on-chain / Lightning) for every amount; card, Apple Pay or Google Pay via Mollie (Visa, Mastercard — the methods Mollie offers at checkout) from $10. Card payments are charged in USD; your bank may apply its own conversion.
Credit is delivered digitally and immediately: as soon as the payment is confirmed (card: seconds; coins: after chain confirmation) the app collects the credit automatically. There is nothing to ship.
Credit is digital content delivered immediately. By completing a purchase you expressly agree that delivery begins at once and acknowledge that you thereby lose your right of withdrawal (§ 356 (5) BGB / Art. 16 (m) Consumer Rights Directive). Credit is issued as bearer tokens that cannot be traced back to a purchase, so we cannot verify whether credit is unspent — purchases are therefore final and non-refundable. If a payment was confirmed but no credit arrived, contact us with the invoice memo within 14 days and we will investigate and credit you.
There is no user account in the usual sense: your access is a 24-word recovery phrase generated on your device. We do not know it and cannot restore it. Whoever holds the phrase holds the credit. Keep it safe.
You may not use the service to break the law, to generate content that infringes the rights of others, or to attack the service or the networks it relies on. The third-party models' own usage policies apply to the content they produce. We may refuse service where required by law.
The service is provided as a test build ("testnet"), without warranty of uninterrupted availability. Model prices follow the providers' prices and may change; a change never affects credit already bought — the number of SCRAI you hold stays the same. We may change these terms for future purchases; the version in force at the time of purchase applies.
We are liable without limitation for intent, gross negligence and damage to life, body or health. For slight negligence we are liable only for breach of essential contractual duties, limited to the foreseeable, typical damage. Model output is generated automatically and may be wrong; it is not advice.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of the country you live in remain unaffected. Contact: hermes-stakepool@proton.me.
